ONLINE AUCTION TERMS & CONDITIONS
AGREEMENT TO TERMS
By registering and placing a bid, you acknowledge that you have read, understand, and agree to these Terms & Conditions. All bids are binding and cannot be withdrawn.
ALL ITEMS SELL AS-IS, WHERE-IS
All property is sold AS-IS, WHERE-IS, with all faults and without warranties or guarantees of any kind, expressed or implied.
Descriptions, photographs, measurements, and information are believed to be accurate but are not guaranteed. It is the bidder’s responsibility to inspect items and determine condition before bidding.
Failure to inspect an item does not relieve the buyer of responsibility for their purchase.
BUYER’S PREMIUM
A 2% Buyer’s Premium will be added to the final bid price of each lot, with a maximum Buyer’s Premium of $750 per lot.
PAYMENT
Payment is due no later than Friday, September 11, 2026, at 5:00 PM (CT) unless prior arrangements have been approved by Kirkendall Auction Services.
Accepted forms of payment:
- Cash
- Approved Check
- ACH Transfer
- Wire Transfer
- Credit Card (processing fees may apply)
Nebraska sales tax will be collected where applicable unless a valid exemption certificate is on file prior to payment.
No items may be removed until payment has been received in full and all funds have cleared, if applicable.
PICKUP
Most items remain at the seller’s location until sold.
After payment has been received and verified, Kirkendall Auction Services will provide pickup authorization and seller contact information when applicable.
Unless otherwise stated, all purchases must be removed within 14 calendar days following the auction closing.
Items not removed within 14 days may be subject to storage fees, relocation fees, or resale at the sole discretion of Kirkendall Auction Services without refund.
FIREARMS
All federal, state, and local firearm laws apply.
All firearms will be transferred through a Federal Firearms License (FFL) dealer designated by Kirkendall Auction Services. Firearms will not be released directly to the buyer.
Buyers are responsible for:
- FFL transfer fees
- Background check fees
- Shipping, packaging, insurance, and receiving FFL fees (if shipped)
Local buyers are also required to complete the transfer through the designated FFL and are responsible for applicable transfer and background check fees.
Buyers possessing a valid Nebraska Firearm Purchase Certificate or Nebraska Concealed Handgun Permit may have the background check handled in accordance with applicable law and the policies of the transferring FFL. Applicable transfer fees still apply.
If a buyer cannot legally possess a firearm, fails the required background check, refuses to complete the transfer, or otherwise defaults, no refund will be issued and the buyer remains responsible for all applicable fees and any loss resulting from the resale of the firearm.
INSPECTION
Inspection is encouraged prior to bidding and may be available by appointment.

SOFT CLOSE
This auction utilizes a soft-close format.
Any bid placed within the final 3 minutes (180 seconds) of a lot will automatically extend that lot by an additional 3 minutes.
Lots will begin closing at approximately 60-second intervals.
NON-PAYING BIDDERS
Failure to complete payment may result in suspension or permanent revocation of bidding privileges.
The buyer may also be responsible for any losses resulting from the resale of unpaid items, including commissions, collection costs, attorney fees, court costs, storage fees, and other related expenses.
ITEM DESCRIPTIONS
Bidders are purchasing the item described, not solely what is shown in the photographs.
While every effort is made to provide accurate descriptions, errors may occur.
Kirkendall Auction Services reserves the right to correct catalog errors, update descriptions, or withdraw any item prior to the close of bidding.
INTERNET BIDDING
Kirkendall Auction Services is not responsible for internet outages, software issues, delayed bids, or technical failures beyond our control.
The Auction Company reserves the right to extend, suspend, or reopen bidding if technical issues occur.
AUCTION COMPANY RIGHTS
Kirkendall Auction Services reserves the right to:
- Reject or revoke bidder registrations.
- Withdraw, add, combine, or divide lots.
- Correct catalog or clerical errors.
- Extend or modify closing times due to technical issues or unforeseen circumstances.
- Cancel any sale when deemed necessary.
LIABILITY
Kirkendall Auction Services acts solely as an agent for the seller unless otherwise stated.
Neither Kirkendall Auction Services nor the seller shall be liable for accidents, injuries, theft, damage, loss, or expenses associated with inspection, bidding, payment, pickup, transportation, loading, or use of purchased property.
GOVERNING LAW
These Terms & Conditions shall be governed by the laws of the State of Nebraska.
Any disputes arising from this auction shall be resolved in the appropriate court located in Richardson County, Nebraska.
