BUYER'S PREMIUM: A 15% Buyer's Premium will be added to the final bid price of all lots.
ALL ITEMS SELL AS-IS, WHERE-IS WITH ALL FAULTS & FLAWS: All items sell with no warranty stated or implied. Merchandise in this auction may include overstock, shelf pulls, open-box items, customer returns, and other merchandise. Items may have cosmetic damage from shipping or handling, including cracks, dents, paint chips, scratches, damaged packaging, missing parts, or other flaws.
Kirkendall Auction Service will test items when reasonably practical. Testing information and any known condition issues may be stated in the individual lot description. A statement that an item was "tested" or "working" reflects the item's condition at the time of testing and does not guarantee continued operation or that every feature, function, component, or accessory has been tested.
Bidders are strongly encouraged to inspect items prior to bidding.
PAYMENT: All invoices must be paid within 24 hours after the auction closes and prior to pickup.
We accept CASH, CHECK, WIRE TRANSFERS, and CREDIT CARDS. Any invoice over $5,000 must be paid by wire transfer and will incur a $20 wire fee. Invoices under $5,000 may be paid by cash, check, or credit card. Credit card payments are subject to a 3.5% convenience fee and should be completed online.
Returned checks will incur a $50 fee. No items will be released until payment has been made. Any invoice remaining unpaid after the payment deadline may be subject to a $25 per day late fee, and bidding privileges may be suspended or revoked.
SALES TAX: Nebraska sales tax of 7.5% will apply where applicable. Additional local sales taxes may also apply. Tax-exempt buyers must provide a completed Nebraska Form 13 unless a valid exemption is already on file with Kirkendall Auction Service.
LOADING & PICKUP: Items must be picked up on Friday, October 2 and Saturday, October 3, 2026, from 12:00 PM to 6:00 PM. Pickup location will be annotated on invoice.
Buyers are responsible for bringing their own loading assistance, tools, equipment, trailers, straps, and anything else necessary to safely remove and transport their purchases.
Items not picked up during the scheduled loadout times without prior arrangements may be considered forfeited, and bidders may be banned from future auctions. No refunds will be issued for items that are not picked up.
STAGGERED & SOFT CLOSING: Lots are scheduled to close one minute apart, beginning with Lot 1 at 5:00 PM CT.
This auction features a soft close. If a bid is placed within the final two (2) minutes of a lot, an additional two (2) minutes will be added to that lot's closing time. Additional qualifying bids will continue to extend that lot until no bids are received during the extension period.
GROUPED LOTS: Certain similar lots may be grouped together and close simultaneously. If bidding occurs on one of the grouped lots, all lots within that group may extend.
INSPECTION: All items are available for inspection prior to the auction during the designated inspection period. Buyers are strongly encouraged to inspect items and determine condition before bidding. It is solely the buyer's responsibility to determine condition, completeness, value, and suitability and to bid accordingly.
NONPAYING BIDDERS: Nonpaying bidders may be banned indefinitely from participating in future Kirkendall Auction Service auctions. Any losses, legal fees, collection expenses, or other reasonable costs incurred due to nonpayment may be the responsibility of the buyer where permitted by law.
CATALOG DISCREPANCIES: Buyers are bidding on the described item and should not rely solely on photographs. Descriptions, photographs, model numbers, measurements, quantities, and other catalog information are believed to be accurate but are not guaranteed. Bidders are responsible for reviewing all available information and inspecting items when possible before bidding.
ALL SALES ARE FINAL. NO RETURNS, REFUNDS, OR EXCHANGES.
TITLED ITEMS: A $25 title fee will apply to any titled item. Titles will be mailed by certified mail within 21 days after payment and pickup are completed.
AUCTION CHANGES: Kirkendall Auction Service reserves the right to withdraw or re-catalog items, correct catalog errors, extend or modify closing times, or postpone or cancel the auction if necessary, due to technical or operational issues. All sales are final upon certification by Kirkendall Auction Service.
